These GTC apply to consumers. For businesses, the B2B GTC at /en/terms-b2b/ apply. Last updated: November 2026, version 1.0.
1. Scope
These general terms and conditions (GTC) apply to all offers, deliveries and services of HASHLYNK to consumers in the fields of mechatronics, automation, software, project planning, development, consulting as well as repair and maintenance. Deviating terms of the client only apply if HASHLYNK has expressly recognised them in writing.
2. Offer & conclusion of contract
Our offers are non-binding until the written order confirmation. The contract is concluded in writing by e-mail or letter through HASHLYNK’s order confirmation. A request via the website (for example site assessment or contact form) is non-binding and does not create a contract.
Orders in the online shop are binding. The contract is concluded by clicking the “Order with obligation to pay” button. HASHLYNK confirms the order by e-mail without undue delay and sends these GTC, the withdrawal instructions and the model withdrawal form with it.
After conclusion of the contract, the client receives a copy of the GTC and an order confirmation with the essential contents of the contract.
3. Right of withdrawal
Consumers have a statutory right of withdrawal for contracts concluded away from business premises and for distance contracts in accordance with §§ 11 et seq. of the Austrian Distance and Off-Premises Contracts Act (FAGG).
The withdrawal period is 14 days. For purchase contracts it begins with receipt of the goods, for service contracts with the conclusion of the contract. Withdrawal can be declared in any form, for example by e-mail to office@hashlynk.at, by letter, with the model withdrawal form or online via the “Withdraw from contract” button on our website. The withdrawal instructions and the model withdrawal form are attached to these GTC as annexes and are enclosed with the offer.
The right of withdrawal lapses for contracts for the delivery of goods that have been manufactured to customer specifications or are clearly tailored to the personal needs of the consumer (§ 18(1)(3) FAGG). The client will be expressly informed of any exclusion of the right of withdrawal before the contract is concluded.
For service contracts whose performance was begun before the end of the withdrawal period at the express request of the consumer, the consumer is obliged to pay proportionate compensation for the services already rendered up to the withdrawal.
4. Types of service
HASHLYNK provides in particular the following services to consumers:
- Delivery of mechatronic devices, machines and special systems
- Software and control system development
- Technical consulting and planning
- Repair and maintenance
The type and scope of the service are determined exclusively by the respective offer or order confirmation.
5. Prices
All prices are final prices including statutory VAT. Shipping by post incurs additional shipping costs. They depend on the country of delivery and are shown as a separate item including VAT before the contract is concluded. Any further additional costs are shown transparently to the client before the contract is concluded.
6. Terms of payment
For the delivery of goods, HASHLYNK issues an invoice for the purchase price after the order confirmation or, for orders in the online shop, immediately after the order. The invoice amount is to be paid by bank transfer before delivery (payment in advance). HASHLYNK delivers only after payment has been received in full.
For services charged by effort (project planning, design, development, repair and maintenance), invoicing is based on the actual effort upon completion of the work, by invoice. After completion, HASHLYNK issues a detailed invoice for the services provided. Payment is due within 14 days without deduction.
In the event of late payment, HASHLYNK is entitled to suspend further services. Default interest is charged in accordance with the statutory provisions.
7. Delivery time & change management
Delivery and performance periods begin once all technical matters have been clarified and, for deliveries of goods, once the invoice amount has been received. Agreed delivery dates are binding if they have been recorded in writing as such.
In the event of unforeseen delays, HASHLYNK will inform the client without delay and name a new expected date. If a binding date is exceeded by more than four weeks, the client is entitled to withdraw from the contract and to reclaim payments already made, provided that HASHLYNK is responsible for the delay.
If the client wishes to change the agreed scope of services, HASHLYNK must be notified of this in writing without delay. Changes are offered and commissioned separately. HASHLYNK is entitled to extend the delivery period in line with the additional work.
8. Force majeure
Events of force majeure (e.g. war, natural events, supply chain disruptions for which HASHLYNK is not responsible, power failures, official measures) entitle HASHLYNK to a reasonable extension of the performance or delivery period. If the impediment lasts longer than eight weeks, both parties are entitled to withdraw from the contract. In this case, services already rendered are to be remunerated proportionately.
9. Retention of title
Goods delivered remain the property of HASHLYNK until all claims arising from the respective contractual relationship have been paid in full.
10. Acceptance / commissioning
Commissioning is carried out by the client or, for a separate charge, by HASHLYNK.
We ask the client to inspect the service upon handover and to report obvious defects promptly. The consumer’s statutory rights remain unaffected.
11. Warranty
The mandatory statutory warranty provisions of Austrian law (ABGB, KSchG) apply.
The warranty period is two years from handover of the item or from acceptance of the service.
In the event of a defect, the client is initially entitled to repair or replacement. If neither is possible or reasonable, or if HASHLYNK refuses to remedy the defect, the client is entitled to a price reduction or, in the case of significant defects, to rescission (reversal of the contract).
There is no warranty for:
- Wear parts in the case of intended use
- Damage caused by improper use or operation outside the intended technical limits
- Changes or interventions by third parties
- Third-party components (only the manufacturer’s warranty applies here)
12. Operating conditions & customer obligations as a prerequisite for warranty
Warranty claims require that the machines, systems and equipment supplied are operated exclusively within the technical limits specified by the manufacturer or by HASHLYNK. Unless otherwise agreed in writing, the limit values stated in the respective data sheets, manuals or technical documentation are binding.
The client is responsible for providing and properly implementing all necessary external protection and infrastructure measures. This includes in particular:
For electrical systems:
- Dimensioning and installation of the supply line in accordance with the requirements of the system
- Selection and installation of suitable upstream fuses
For all devices and systems:
- Sufficient air conditioning and temperature control at the installation site
- Suitable installation site (protection against moisture, dust, vibration etc.)
- Compliance with the permissible noise level limits of the surroundings
For hydraulic devices and systems:
- Installation and maintenance of suitable filter equipment
- Provision and operation of the necessary safety equipment
- Shut-off devices in accordance with the technical requirements
- Cooling of the hydraulic medium, unless this has been expressly agreed as part of HASHLYNK’s delivery
If the client fails to meet these obligations, the warranty claim for resulting damage or malfunctions lapses.
13. Liability
HASHLYNK is liable without limitation for damage caused by intent or gross negligence. Liability for slight negligence is limited to foreseeable damage typical of the contract.
Liability for indirect damage, consequential damage or lost profit is excluded in the case of slight negligence, to the extent permitted by law.
Personal injury is always compensated without limitation. Mandatory statutory liability provisions in favour of consumers remain unaffected.
14. Software, source code & rights of use
If software, programs or digital systems are part of the service, the client receives a simple, non-transferable right of use for the contractually agreed private purpose.
The source code remains with HASHLYNK unless expressly agreed otherwise in writing. Passing on, reproducing or modifying the software is not permitted without the written consent of HASHLYNK.
Maintenance, updates or further development after completion of the project are not part of the original order and require a separate agreement.
15. Withdrawal / project cancellation
If the client withdraws from the contract, outside the statutory right of withdrawal and without HASHLYNK having caused the reason, the services rendered up to that point as well as material and third-party costs incurred are to be remunerated proportionately. Down payments already made are offset against these claims; any surplus will be refunded.
16. Confidentiality
All documents, drawings, software, concepts and information provided must be treated confidentially and may not be passed on to third parties without the express written consent of HASHLYNK.
17. Data protection
The personal data collected in the course of the business relationship is processed exclusively to perform the contract and is not passed on to third parties without consent. The provisions of the GDPR and the Austrian Data Protection Act (DSG) apply.
The client has the right to access, rectification, erasure and restriction of processing of their personal data as well as the right to data portability. Requests must be addressed to HASHLYNK in writing.
Further information on data processing is available in the privacy policy on our website.
18. Dispute resolution
In the event of disputes arising from this contract, the consumer may use out-of-court dispute resolution. HASHLYNK submits to alternative dispute resolution proceedings for consumers before the Internet Ombudsstelle (www.ombudsstelle.at). Complaints can also be sent directly to office@hashlynk.at.
19. Place of jurisdiction & law
Austrian law applies exclusively, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For actions against the consumer, the consumer’s general place of jurisdiction (court of residence) applies. For actions by the consumer against HASHLYNK, the District Court of Spittal an der Drau (Bezirksgericht Spittal an der Drau) has jurisdiction.
20. Severability clause
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions remains unaffected. The invalid provision is to be replaced by a valid one that comes closest to the economic purpose of the invalid provision.
Special conditions for the HashLink software licence (subscription)
21. Contract term and renewal
The HashLink licence is concluded as an annual subscription. The term begins on the day the HashLink Controller is commissioned. Commissioning is the point at which miners are connected to the controller. The term begins no later than one month after delivery of the controller, even if commissioning has not taken place by then. When the term begins, HASHLYNK issues the invoice for the first billing period. A billing period is one year. The subscription is automatically renewed for a further billing period in each case unless it is terminated. The consumer is expressly informed of the automatic renewal before the contract is concluded.
22. Right of withdrawal for the licence subscription
The consumer has the statutory right of withdrawal of 14 days from conclusion of the contract (see point 3). If the consumer expressly requests that the licence be activated before the end of the withdrawal period, in the event of withdrawal they must pay a proportionate fee corresponding to the scope of service already provided.
23. Termination
The subscription can be terminated at any time without any particular form, for example by e-mail to office@hashlynk.at. The termination takes effect at the end of the current billing period. Fees already paid in advance for the current billing period are not refunded pro rata; fees already paid for billing periods that have not yet begun will be refunded.
24. Fee and due date
The licence fee is due in advance for the coming billing period. For consumers, prices are shown including statutory VAT.
25. Price adjustment
HASHLYNK reserves the right to adjust the licence fee once per calendar year in line with the change in the consumer price index (Verbraucherpreisindex, VPI) published by Statistik Austria. The change between the VPI of the month before the last price setting and the VPI of the month before the adjustment is decisive. The consumer will be notified of an adjustment in text form at least eight weeks before it takes effect. The consumer may terminate the subscription until the adjustment takes effect, with effect from the end of the current billing period; this right of termination is expressly pointed out in the notification. If the consumer does not terminate, the adjustment is deemed accepted.
26. Licence tier and change of tier
The licence tier corresponds to the number of miner slots activated for the controller. Slots are activated and changed exclusively by HASHLYNK; the consumer cannot change the number themselves. A change of tier takes place at the consumer’s request. The activation of additional slots (upgrade) takes effect immediately; the existing subscription ends at this point and is replaced by the subscription of the higher tier. The prepayment for the higher tier becomes due immediately with the upgrade; fees already paid for the terminated tier are credited pro rata for the unused period. A reduction in the number of slots (downgrade) takes effect at the start of the next billing period.
27. Technical capacity per controller
A HashLink Automation Controller can technically manage up to 254 miner slots. From 100 connected miners, HASHLYNK recommends using an additional controller for performance reasons.
28. Late payment of the subscription
If payment is more than 30 days overdue, the licence is reset to the free tier S0 after a prior reminder and the setting of a grace period of at least 14 days. Once payment has been received in full, the booked tier is reactivated.
Annexes to the B2C GTC
Annex 1: Withdrawal instructions
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason. The withdrawal period is 14 days from the day on which you or a third party named by you, other than the carrier, took possession of the goods. For service contracts, the withdrawal period is 14 days from the day the contract was concluded.
To exercise your right of withdrawal, you must inform us (HASHLYNK GmbH, Mölltalstraße 43/1, 9813 Möllbrücke, Austria, e-mail: office@hashlynk.at, phone: +43 650 264 687 0) of your decision to withdraw from this contract by means of a clear statement, for example by letter or e-mail. You may use the attached model withdrawal form, but this is not obligatory. You can also declare the withdrawal online via the “Withdraw from contract” button on our website. We will confirm receipt by e-mail without undue delay. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.
The right of withdrawal does not apply to contracts for the delivery of goods that have been manufactured to your specifications or are clearly tailored to your personal needs.
Effects of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including the costs of delivery (with the exception of the supplementary costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than 14 days from the day on which we received the notice of your withdrawal. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for this reimbursement.
We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest. You shall send back the goods or hand them over to us without undue delay and in any event not later than 14 days from the day on which you inform us of your withdrawal. The deadline is met if you send back the goods before the period of 14 days has expired. You will bear the direct cost of returning the goods. You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods.
If you requested that the services or the activation of the licence begin during the withdrawal period, you shall pay us a reasonable amount which corresponds to the proportion of the services already provided until you inform us of the exercise of the right of withdrawal, in comparison with the full scope of the services provided for in the contract.
Annex 2: Model withdrawal form
